Hiking Agency Experience – KochaGuide, Nejc Košnik s.p.

1. General Provisions

These General Terms and Conditions (Terms) govern the rights and obligations between Hiking Agency Experience, KochaGuide, Nejc Košnik s.p., Cesta 1. maja 63, 4000 Kranj (the Organizer) and any individual who registers for a programme offered by the Organizer (the Participant).

The Organizer prepares and carries out various programmes, particularly hikes, trekking tours and via ferrata activities, as well as other related sports, recreational or tourist programmes.

By registering for a programme, the Participant confirms that they are familiar with the programme, its content, duration, difficulty level, participation requirements and these Terms, and that they accept them.

Specific programmes may include additional special conditions stated in the programme description, offer, registration form or other information provided to the Participant. In case of conflict between the special conditions of a specific programme and these Terms, the special conditions shall prevail for that programme, if explicitly stated.

2. Registration and Contract Formation

The Participant registers for a programme in the manner determined by the Organizer, typically via an online registration form, email or another agreed method.

Registration is binding. The contractual relationship between the Organizer and the Participant is established once the Organizer confirms the registration or once the Participant makes the required payment, if specified in the programme or offer.

After registration or confirmation, the Organizer provides the Participant with information regarding the programme, price, payment method and other essential details.

The Participant must review all documents received and notify the Organizer of any errors or inconsistencies without undue delay.

If payment of a deposit or another amount is required for confirmation, the registration is considered final once the payment is received, unless stated otherwise in the programme.

3. Payment

3.1 Multi-day Programmes (with accommodation)

The deposit amount and payment deadlines are specified in each programme, offer or invoice. Unless stated otherwise, the deposit amounts to 40% of the programme price.

The remaining balance must be paid by the deadline indicated on the invoice or programme information, typically no later than 14 days before the start of the programme.

Different payment deadlines may apply to programmes involving accommodation, transport, flights, tickets or other services. These are specified in the programme or offer.

If the Participant fails to pay the due amount within the agreed deadline, the Organizer may cancel the registration and charge cancellation fees in accordance with these Terms or the special conditions of the programme.

3.2 One-day Programmes (without accommodation)

For one-day programmes, the full programme price must be paid upon registration or upon confirmation, unless stated otherwise.

Changes to the number of participants can be accommodated up to 2 days before the start of the programme. After this point, the confirmed number of participants becomes binding.

4. Programme Price and Included Services

The programme price is stated in each programme or offer.

The price includes only the services explicitly listed in the programme.

Unless stated otherwise, the price does not include personal expenses, additional food or drinks, entrance fees, cable car surcharges, insurance, special equipment or any services not listed as included.

The Organizer may specify additional surcharges for individual programmes.

5. Special Services

Special services are services not included in the basic programme price and must be ordered separately. These may include special dietary requirements, additional transport, additional luggage, special entrance fees or other services listed in the programme.

6. Price Changes

Programme prices are stated in the programme or offer.

If the price depends on third-party costs beyond the Organizer’s control, the price may change in accordance with applicable legislation, particularly due to changes in transport costs, energy prices, third-party services, taxes, fees or other objective costs.

If a fixed price is stated for a programme, the Organizer will not change the price after contract formation, unless permitted by applicable legislation.

7. Cancellation by the Participant

7.1 Multi-day Programmes (with accommodation)

If no special cancellation conditions are stated for a programme, the Organizer is entitled to the following cancellation fees:

  • up to 60 days before departure: 10%, minimum €15
  • 59–45 days: 15%
  • 44–30 days: 30%
  • 29–22 days: 50%
  • 21–15 days: 80%
  • 14 days or less: 100%

Special or non-refundable costs (accommodation, transport, flights, tickets, cable cars, etc.) may be charged in full according to actual costs or special programme conditions.

If the Participant does not start, attend or leaves the programme early, they are not entitled to a refund unless required by law or agreed otherwise.

7.2 One-day Programmes (without accommodation)

For one-day programmes, the following cancellation policy applies:

  • Cancellation up to 7 days before departure: 100% refund
  • Cancellation 3–7 days before departure: 50% refund
  • Cancellation less than 3 days before departure: no refund
  • No-show: no refund

Changes to the number of participants are possible up to 2 days before the start; after that, the confirmed number is binding.

If the Participant misses the departure time or fails to appear at the meeting point, the programme is carried out without them and no refund is issued.

8. Risk of Cancellation and Cancellation Insurance

The Organizer recommends cancellation insurance, especially for programmes with higher potential cancellation costs.

The Organizer enables Participants to obtain cancellation insurance through Generali Insurance.

For detailed information regarding coverage, limitations, exclusions, insured amounts, claim procedures and other insurance conditions, the following documents issued by the insurer apply:

  • Insurance Clause

These documents form an integral part of the insurance information and must be reviewed by the Participant before concluding the insurance contract.

Whether a specific case is covered and in what amount is determined solely by the insurance company in accordance with its insurance conditions. The Organizer does not decide on eligibility for insurance compensation.

9. Health Insurance for Travel Abroad

For programmes abroad, the Organizer recommends obtaining international health insurance with assistance.

Insurance is voluntary unless stated otherwise in the programme.

10. Cancellation or Modification of the Programme by the Organizer

The Organizer may cancel a programme before its start if the minimum number of participants required for its execution is not met.

The Organizer may also cancel, postpone or modify a programme due to circumstances that cannot be prevented, eliminated or avoided, or which would make the execution unsafe or significantly hindered. Such circumstances include adverse weather, dangerous trail conditions, trail or via ferrata closures, natural disasters, fires, landslides, floods, epidemics, strikes, road closures, transport disruptions, war, unrest, official restrictions or other unforeseeable circumstances beyond the Organizer’s control.

During hikes, trekking tours or via ferrata activities, the Organizer or guide may change the route, destination, schedule, difficulty level or any part of the programme if they assess that the originally planned execution is unsafe or unsuitable.

Such modifications are not considered a failure to deliver the programme if made for safety reasons or due to circumstances beyond the Organizer’s control.

If the programme is cancelled and no substitute programme is available, the situation is handled in accordance with applicable legislation and programme conditions.

11. Minimum Number of Participants

If a minimum number of participants is specified for a programme, its execution depends on reaching that number.

If the minimum number is not reached, the Organizer may cancel the programme or propose modified conditions.

12. Guiding and Safety

Programmes are led by qualified guides or other appropriately trained personnel.

For safety reasons, the guide may change the route, destination, schedule, omit parts of the programme, require specific equipment or prevent a Participant from continuing if necessary.

Participation in via ferrata or demanding hikes is permitted only to individuals who meet the programme requirements.

The Participant must follow the guide’s instructions and use the required equipment.

13. Programme Difficulty and Health Conditions

Before registering, the Participant must assess whether their physical fitness is suitable for the programme.

The Organizer provides essential information regarding difficulty, duration, elevation gain, route length and other relevant characteristics.

The Participant must inform the Organizer or guide of any health issues relevant for safe participation.

The Organizer or guide may advise against or prevent participation if the Participant’s health, fitness, equipment or other circumstances pose a risk.

14. Participation at Own Risk

Hiking, trekking and via ferrata activities involve inherent risks associated with natural and mountain environments, weather conditions, terrain difficulty, altitude, slips, falls and other factors.

The Participant must understand these risks and participate responsibly.

Signing a participation-at-own-risk statement does not exclude the Organizer’s liability where established under applicable law.

15. Non-Participation or Exclusion of a Participant

The Organizer or guide may prevent a Participant from starting or continuing the programme if they lack required equipment, do not meet participation conditions, pose a health or safety risk, fail to follow instructions, behave inappropriately or are under the influence of alcohol or drugs.

If exclusion results from circumstances on the Participant’s side, they are generally not entitled to a refund unless required by law.

16. Travel and Personal Documents

For programmes abroad, the Participant is responsible for having valid travel documents and meeting entry requirements.

If the Participant cannot join the programme due to invalid or missing documents, they bear all resulting costs.

17. Transport

If transport is included, it is carried out using appropriate vehicles or transport providers.

The Organizer is not responsible for delays, changes or cancellations caused by the transport provider or circumstances beyond the Organizer’s control unless liability is established under applicable law.

18. Luggage and Personal Belongings

The Participant is responsible for their luggage and personal belongings.

The Organizer is not responsible for loss, theft or damage unless liability is established under applicable law.

19. Health and Other Requirements

The Participant is responsible for meeting health, hygiene, entry and other requirements applicable in the programme area.

20. Organizer’s Liability

The Organizer is responsible for proper execution of services undertaken within the programme, in accordance with applicable legislation.

The Organizer is not liable for damage resulting from circumstances beyond their control or from actions of the Participant or third parties.

21. Complaints

The Participant must report any irregularities during the programme as soon as possible.

Claims must be submitted in accordance with applicable legislation and include a detailed description and supporting evidence.

22. Programme Information

Information provided on the Organizer’s website, in offers or communicated to the Participant forms the basis for their decision to register.

Photographs and visual materials are illustrative and may not represent actual conditions at the time of the programme.

23. Personal Data Protection

Personal data is processed in accordance with applicable legislation and the Organizer’s Privacy Policy.

24. Photography and Use of Images

If photography or filming takes place during the programme, the use of such material for promotional purposes is carried out in accordance with applicable legislation and the Organizer’s Privacy Policy.

25. Final Provisions

These Terms are governed by the law of the Republic of Slovenia.

If any provision is invalid or unenforceable, the remaining provisions remain in force.

These General Terms and Conditions enter into effect on the date of their publication on the website of Hiking Agency Experience.
